Terms of Service

These Terms of Service ("Terms") govern your use of the Fotocal mobile application (Android package: com.fotokal.app) and this website. By downloading or using Fotocal you agree to these Terms. If you do not agree, do not use the application.
1. The service
Fotocal is a nutrition and health tracking application that uses artificial intelligence to estimate calories, macronutrients and food quality from photos, barcodes and menus, and offers features such as a meal diary, water and weight tracking, step counting, an AI coach ("Coach Kal"), streaks, weekly recaps and reminders.
2. Important notice: not medical advice
Fotocal provides informational estimates generated by AI and habit-tracking tools. It is not a medical device and does not replace advice from a doctor, dietitian or nutritionist. Always consult a health professional before making significant changes to your diet, especially if you have a medical condition, are pregnant, or have a history of eating disorders.
3. Account
- You must be at least 16 years old to use Fotocal.
- You are responsible for keeping your credentials confidential and for the activity on your account.
- You must provide accurate information and keep it up to date.
- You may delete your account at any time (see account deletion).
4. Fotocal Pro subscriptions
Fotocal can be downloaded and used for free with core features. Premium features require a Fotocal Pro subscription:

Prices may vary by country and are always displayed in Google Play before you confirm the purchase.
4.1 Auto-renewal
- All subscriptions renew automatically at the end of each period, for the same term and at the then-current price, unless you cancel at least 24 hours before the end of the current period.
- Payment is charged through your Google Play account.
4.2 Free trial
- The Pro Yearly plan includes a 5-day free trial for new subscribers.
- If you do not cancel before the trial ends, the yearly subscription activates and payment is charged automatically.
- If you cancel during the trial, you are not charged and premium access ends when the trial ends.
- The free trial can only be used once per user/Google Play account.
4.3 Cancellation
You can cancel at any time via Google Play → Profile → Payments & subscriptions → Subscriptions → Fotocal. Cancellation takes effect at the end of the paid period: you keep premium access until that date and no further charges are made. Uninstalling the app does not cancel your subscription.
4.4 Refunds
Payments are processed through Google Play and refunds are governed by the Google Play refund policy. Your statutory consumer rights remain unaffected.
4.5 Price changes
If we change a subscription price, you will be notified through Google Play in advance, and the new price will only apply from the next renewal, in accordance with Google Play policies.
5. Acceptable use
You agree not to:
- Use Fotocal for unlawful or unauthorized purposes.
- Attempt to access other users' data or Fotocal systems without authorization.
- Reverse-engineer, copy or resell the application or its AI services.
- Abuse the service (e.g., mass automation of AI requests).
6. User content and data
You retain all rights to the data and photos you upload. You grant us a limited license to process them solely to provide the service to you, as described in our Privacy Policy.
7. Intellectual property
Fotocal, its logo, design, code and content are the property of Fotocal or its licensors and are protected by intellectual property laws. These Terms do not transfer any ownership rights to you.
8. Accuracy of estimates
AI-generated nutrition estimates (calories, macros, quality scores and recommendations) are approximate and may contain errors. We do not guarantee their accuracy, and you should not base medical decisions on them.
9. Limitation of liability
To the maximum extent permitted by law, Fotocal shall not be liable for indirect, incidental or consequential damages arising from the use of, or inability to use, the app. Nothing in these Terms limits liability that cannot legally be limited, nor your mandatory consumer rights.
10. Service availability
We work to keep Fotocal continuously available but do not guarantee uninterrupted availability. We may modify, suspend or withdraw features, notifying you of significant changes.
11. Termination
We may suspend or close your account if you seriously or repeatedly breach these Terms. You may stop using the service and delete your account at any time.
12. Changes to these Terms
We may update these Terms. The current version will always be published on this page, and we will notify you in the app of substantial changes. Continued use after they take effect constitutes acceptance of the new Terms.
13. Governing law
These Terms are governed by the laws of Spain, without prejudice to the mandatory consumer protection rules of your country of residence. Any dispute shall be submitted to the competent courts in accordance with applicable consumer regulations.
